These Terms of Service (“Terms”) govern your access to and use of the FLHIP website, platform, and services (collectively, the “Service”) operated by FLHIP (“FLHIP,” “we,” “us,” or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
FLHIP is a subscription service that identifies new and upcoming restaurant and hotel openings and provides that information as sales leads to hospitality-industry vendors. Leads are organized into geographic zones. Your subscription grants access to leads within the zone(s) you subscribe to, for the duration of your active subscription.
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate registration information and to keep it current. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at ken@flhip.com of any unauthorized use.
Subscriptions are billed in advance on a recurring basis through our third-party payment processor, PayPal. By subscribing, you authorize recurring charges to your selected payment method until you cancel. Subscriptions renew automatically at the then-current rate for the applicable zone(s) unless cancelled before the renewal date. We may change subscription pricing; any change applies to billing periods beginning after we provide notice.
You may cancel at any time from the My Account page; cancellation stops future billing and access continues through the end of the current paid period. All payments are non-refundable as described in our Refund Policy, which is incorporated into these Terms.
Lead data is licensed to you for your own internal business and sales-outreach purposes only. You agree that you will not:

The Service, including its software, design, compilations, and the structure and presentation of lead data, is owned by FLHIP and protected by applicable laws. Except for the limited license described above, no rights are granted to you. The FLHIP name and logo are our marks and may not be used without permission.
The Service and all lead data are provided on an “as is” and “as available” basis. FLHIP compiles lead information from public and third-party sources and does not warrant that any lead is accurate, current, complete, or that contacting a lead will result in any sale, contract, or other outcome. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Service is currently offered in beta and may change, be interrupted, or contain errors.
To the fullest extent permitted by law, FLHIP and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising from or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid to FLHIP in the three (3) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless FLHIP and its owners and providers from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your outreach to leads, or your violation of these Terms or applicable law.
We may suspend or terminate your access at any time for violation of these Terms, suspected fraud or abuse, or to protect the Service or other users. You may stop using the Service at any time by cancelling your subscription. Sections that by their nature should survive termination (including Sections 5–9 and 11) will survive.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date, and material changes take effect when posted. Your continued use of the Service after changes are posted constitutes acceptance.
